Lost $1,850 on a commercial lease clause I didn't read closely, lawyer said I was stuck
I signed a 3 year lease for a small office suite in Boise last spring and skipped over the personal guarantee section because the broker kept saying it was standard. When my tenant bailed 8 months in, the landlord came after me directly for the remaining rent and I paid $1,850 out of pocket before I could sublease the space. A lawyer friend looked at it later and pointed out the clause said "jointly and severally liable" which meant I was on the hook even after assigning the lease. Has anyone here negotiated that language down before signing, or is it just take it or leave it with smaller landlords?
