I finally read the non-compete in my $2,800 design contract and it bans me from working for ANY similar business for 18 months
Last Tuesday I was cleaning out my email and actually opened the full contract PDF for a $2,800 branding job I finished in March. I had skimmed it when I signed because the client seemed nice and I needed the money, but this time I read every line. Buried on page 4 is a non-compete that says I cannot work with any business that does anything similar to theirs for 18 months within 50 miles of Denver. That covers basically every coffee shop, bakery, and small retail spot in the whole metro area, which is most of my client base. I panicked and called the client to ask if they even wanted that clause, and the guy said his cousin wrote the contract and he had no idea it was in there. He sent me a signed letter saying he releases me from it, but now I am realizing a letter is not the same as a new contract. Has anyone gotten a clause officially removed after signing, or am I stuck hoping this letter holds up if it ever matters?
A letter from the guy probably won't do much if he sells the business or the cousin gets involved later. You want a signed contract amendment or release that both of you sign, not just a friendly note. Push for the real paperwork, it takes ten minutes and saves you a headache if this ever comes up.
