Took me 5 hours to figure out a client stole my logo, is the DMCA route worth it or should I just eat it?
Last Tuesday I found out a former client in Austin, who paid me $800 for a full brand package back in January, was using my logo on their new merch site without my permission and without paying the final invoice. I spent 5 hours going back and forth with their so-called "legal" guy, who kept saying the logo was "a work for hire" even though my contract clearly says I own the rights until final payment. I filed a DMCA takedown with their web host, and now I'm stuck in this loop of emails, plus the host wants a bunch of proof I didn't have ready. So here's my debate: should freelancers bother with the DMCA process for small claims like this, or just cut losses and move on? One side says it's worth it because it sets a precedent and stops the thief, but the other side says it's a time sink and you rarely see a dime. I'm leaning toward just sending a scary letter and calling it, but I keep second-guessing myself. What would you do in my shoes, and have you ever gotten a DMCA takedown to actually stick?
